Watching Duane “Dog” Chapman in the A&E “Dog The Bounty Hunter” is what got me excited about being a Bounty Hunter. So I decided to look into it and get into the fugitive recovery action, probably just like you’re thinking about doing. Or perhaps you are already a Bounty Hunter. Let’s start with some basics. A bounty hunter captures fugitives for a monetary reward, still referred to as a bounty. The name Bounty Hunter has not been well received in the industry the last few years and many would say it is in large part due to the A&E show, Dog The Bounty Hunter. Now, don’t get me wrong, I have never met Duane Chapman but he seems like a very likeable person. I personally like watching Dog The Bounty Hunter and I have all of the DVDs. However, many in the industry believe that his appearance, tactics and the public’s perception of the industry from his show is a black eye on the profession. I will make my position very clear; I do not feel that he is doing a bad thing and I like the fact that he is doing good things with his life and he values his family. The guy is alright in my book! Here at Dan The Bounty Hunter I will do my best to show you both sides of the coin while remaining as neutral as possible. With all things, the pendulum can swing too far one way or the other.

Bail enforcement agent, fugitive recovery agent, and bail fugitive investigator. I also like Bail Surety Investigator which I picked up from Scott Harrell when I took his Apprehending Bail Fugitives and Surveillance Strategies for Success courses. I highly recommend Scott Harrell and his courses; either in person seminar or online. In my newly formed Investigation Company it will be mandatory for all new investigators to attend his courses before going out in the field. As of this writing I haven’t hired an investigator yet; I am still in the infant stages of getting the company together.

This is not necessarily just for the serious minded bail enforcement agent or investigator, but even someone who has no interest in working as a bounty hunter at all. You will find various products used on the job and other products purely for entertainment purposes. Taylor v. Taintor, 83 U.S. 16 Wall. 366 366 (1872)

I will not actually post the entire case here but this particular 1872 Supreme Court case Taylor vs. Taintor, is cited as having established that the person into whose custody the defendant is remanded as part of the defendant’s bail has sweeping rights to recover that person.  Sweeping rights would seem like we have a great deal of latitude to recover our bail secured fugitive. However, the more you learn the more you will see that there is much more to consider.

Obiter dictum – the commonly cited portion of the above case was obiter dictum which is Latin for a statement “said by the way”.  In other words, having sweeping rights to recover the fugitive does not help and it is erroneous because there is no binding precedential value. Dicta would indicate persuasive value.

This short bit of information actually leads into a volume of information that is well out of the scope of Dan The Bounty Hunter.  The bottom line is although bounty hunters often feel they have the right to recover their fugitive regardless; they often break many laws and put themselves and their clients at very high risk. You see a bounty hunter must be empowered to recover a bail secured fugitive and that authority to arrest is given by the bondsman, attorney or surety company that is responsible for the bond. When a bounty hunter is not fully aware of the laws in the state of the apprehension, does not carry insurance, and uses poor apprehension practices, then that places their client in a very risky position. Laws are also often broken even during extradition of the bail secured fugitive and the client is ultimately responsible for the actions of the bounty hunter. So, don’t just watch Dog The Bounty Hunter and read material on Dan The Bounty Hunter then go out for some fugitive hunting. Be sure you get some formal education before attempting to even talk with a bondsman. Be sensitive to their needs and look for ways to help them, not hinder them. Start off on the right foot!
